ICA filed against dismissal of plea seeking disqualification of Nawaz, Nisar

LAHORE: An intra-court appeal (ICA) has been filed in the Lahore High Court (LHC), challenging the dismissal of a petition by a single bench that sought disqualification of Prime Minster Nawaz Sharif and Interior Minister Chaudhry Nisar Ali Khan for allegedly telling lie over the issue of inviting Chief of Army Staff (COAS) General Raheel Sharif to act as an arbitrator and guarantor in prevailing political crisis. Justice Syed Mansoor Ali Shah had on September 2 dismissed the petition by holding that question in hand regarding the statement made by the prime minister on floor of the parliament as well as press release issued by the Inter-Service Public Relations falls within the domain of “political question” and was not justiceable.
The judge also held that the petitioner could agitate this matter before an appropriate political forum, if so required. Insaf Lawyers Forum Punjab Senior Vice President Gohar Nawaz Sindhu petitioned that General Raheel met with Pakistan Tehreek-e-Insaf (PTI) Chairman Imran Khan and Pakistan Awami Tehreek (PAT) Chief Dr Tahirul Qadri for arbitration. He said that the prime minister and the interior minister later told the parliament that the government had not called or requested General Raheel regarding any mediation, facilitation or coordination but that the army chief was playing the role on the request of PTI and PAT leaders.
He had said that on the other hand, the ISPR denied government’s version and thereafter Interior Minister Nisar acknowledged to the media that army intervened on the request of the government to the extent of facilitation only. He submitted that the government tried to give an impression that the army chief intervened on the request of PAT and PTI leaders instead of the government.He said that the media had also updated the nation about the arbitration and that the government or any political party, including PML-N, did not contradict the news.
The petitioner said that the prime minister and the interior minister violated the constitution by telling a lie that they had not invited the COAS to play his role as mediator and facilitator.
